Only H.R. 1 provisions within the applicable REG or TCP Blueprint scope are eligible for testing. Within that scope, provisions effective in 2024 or 2025 became eligible on July 1, 2026; all other provisions become eligible in the calendar quarter beginning six months after their effective date.

Compliance baseline before planning

Calculate the current treatment and constraints before recommending an alternative. A planning answer is incomplete when the baseline consequence is unclear.

Entity and owner consequences

Track what changes at the entity, asset, and owner levels. Separate basis, character, timing, and cash effects before comparing structures.

Assumption and timing discipline

State which facts and tax year control the result. Planning alternatives often change when one assumption, holding period, ownership fact, or effective date changes.

Worked example

Compare two entity or timing choices

Scenario: A taxpayer can complete a transaction in either of two periods. You calculate one period correctly but choose it without comparing cash needs, limitations, and the alternative result.

Practice response: Calculate the baseline and alternative under the rules eligible for the testing date. State the timing assumption, tax effect, cash effect, and any limitation. Recommend only after the same dimensions are compared for both choices.

Worked example

Separate entity and owner basis

Scenario: An entity distribution affects both the entity and owner. Your work combines inside and outside basis, producing a plausible but unsupported answer.

Practice response: Create separate entity, asset, and owner rollforwards. Apply the ordering and limitation at the level where it belongs, then reconcile the tax character and remaining basis for each party.

Important TCP exceptions

  • REG knowledge can reduce relearning, but passing REG is not an official prerequisite and business-law strength alone may not transfer to TCP planning work.
  • Only H.R. 1 provisions within the TCP Blueprint scope are eligible for TCP testing. Within that scope, provisions effective in 2024 or 2025 became eligible on July 1, 2026; all other provisions become eligible in the calendar quarter beginning six months after their effective date.
  • A high historical pass rate does not establish that TCP is easy for an individual candidate. Prior tax experience and candidate selection can affect the tested population.
